The present General Terms and Conditions of Sale (hereinafter referred to as " GT&CS ") are intended to apply exclusively between MyDog&Travel and any person wishing to access the website and/or use the services offered from the website (hereinafter referred to as " the Customer ").
Any use of the services offered via the Website automatically entails the application of these GT&CS.
We recommend that you read them carefully.
General Terms and Conditions of Sale
Preamble
MyDog&Travel (hereinafter also referred to as "the Service Provider") is a micro company that provides a service of advice, research and organization of trips for consumers (hereinafter referred to as "the Services"). This service is detailed and marketed through the website https://www.mydogandtravel.com. The description and the exhaustive list of the services offered are therefore available on the above-mentioned website and can be consulted at any time.
All reservations for services resulting from research carried out by MyDog&Travel (hereinafter referred to as "Third Party Service" or "Third Party Provider") must be finalized by the Client.
Article 1 - Fields of application
These General Terms and Conditions of Sale (hereinafter referred to as "GT&CS") apply, without restriction or reservation, to any purchase of an online travel consulting service, as offered by the Provider to non-professional clients (hereinafter referred to as "the Client") on the website https://www.mydogandtravel.com. The Client is required to read them before placing an order. The choice and purchase of a Third Party Service is the sole responsibility of the Client.
These GT&CS are accessible at any time on the website https://www.mydogandtravel.com and will prevail over any other document. These GT&CS may be modified at any time and without notice by the Provider, said modifications being applicable only to subsequent orders.
The Client declares to have read and understood these Terms and Conditions of Sale and accepts them without reservation before placing an order online on the website https://www.mydogandtravel.com. These GT&CS apply to all orders and acceptance of quotes. Unless proven otherwise, the data recorded in the Provider's computer system constitute the proof of all transactions concluded with the Client.
Article 2 - Rates for the Services
The rates indicated in the packages are provided solely as an indication, on the basis of 1 or 2 people with 1 dog. Any request will be systematically subject to a customized estimate that the Client will have to validate. Any other particular request (group, specific accompaniment, etc...) will be the subject of a custom-made estimate.
Package "Mini-Getaway" up to 4 days : starting at 60€
Package "Fancy an escape" from 5 days to 3 weeks: starting at 130€
Package "Roadtrip mode" for more than 15 days on a multi-stop basis: starting at 180€
Package "Out of the ordinary Stay" - Special request with specific constraints: on estimate only, to be sure to meet your expectations.
An option "VIP Assistance" is available at extra cost and on estimate exclusively. This option can be activated, before departure or during the stay, for all the packages in case the Client wishes to benefit from the services of MyDog&Travel during his stay. The price of this option is established according to the nature and the complexity of the desired assistance.
Examples of possible assistances: modification of an activity because of capricious weather, desire of an additional activity, need to fill a hole in the planning with good additional dogfriendly addresses... Non-exhaustive list.
The Services are provided at the rates at the time the order is placed by the Provider on the website https://www.mydogandtravel.com. These prices are firm and revisable during their period of validity but the Provider reserves the right to modify the prices at any time.
Prices are expressed in Euros (€), VAT not applicable according to article 293 bis of the General Tax Code.
The payment requested from the Client corresponds to the total amount of the order.
Upon acceptance of the order, an invoice is established by MyDog&Travel and sent to the Client. All orders are subject to a previously accepted estimate. The quotations drawn up by MyDog&Travel are valid for a period of 3 (three) months after their establishment.
Article 3 - Terms of Order
The Client contacts MyDog&Travel via its website https://www.mydogandtravel.com by filling in the Contact Form or by e-mail to contact@mydogandtravel.com. A first free contact is then organized within 48 hours to define the needs of the Client. The Client will have to provide certain mandatory information such as the dates and duration of the trip, the destination, the number of travelers, the number and breeds of dogs, the approximate budget allocated to the trip, the type of accommodation and activities desired... This mandatory information is necessary for the research and design of the travel program. If some information were to be missing, MyDog&Travel commits itself to contact the Client in order to obtain it before starting the service.
Upon receipt of the required information, MyDog&Travel checks the feasibility of the trip according to the elements provided by the Client. If the request is feasible, MyDog&Travel will inform the Client by email or by phone, within a period of time that cannot exceed 7 working days from the reception of the obligatory information. If the Client does not reply, the travel request will not be processed.
In case of agreement of the two parts and with reception of all the obligatory information, MyDog&Travel will send to the Client an email of confirmation taking again the essential information relating to its voyage, an estimate and the present GT&CS. To validate his order, the Client must sign each page of the quotation and these GT&CS, and affix his "Agreed and signed". The Client will then send these documents by email to contact@mydogandtravel.com. Any validation of the estimate involves the full and whole adhesion to the present GT&CS, without exception nor reserve.
Upon receipt of the quote and the GT&CS signed by the Client, MyDog&Travel validates the order and sends the corresponding invoice by email to the Client.
The Provider reserves the right to refuse any project that does not respect animal welfare, or any request that is abnormal or made under false pretences or for any other legitimate reason.
The Provider reserves the right not to confirm an order for any reason. The sale will be considered valid only after full payment of the price. It is the Client's responsibility to verify the accuracy of the order and to immediately report any errors. Any order placed via the website constitutes the formation of a contract concluded at a distance between the Client and MyDog&Travel.
The Provider reserves the right to cancel or refuse any order from a Client with whom there is a dispute concerning the payment of a previous order.
The archiving of the communications, the order, the details of the order as well as the invoices is carried out on a reliable and durable support so as to constitute a faithful and durable copy in accordance with the provisions of article 1360 of the French Civil code. This information can be produced as proof of the contract.
Article 4 - Terms of payment
The validation of the quotation implies the acceptance of the rates and the obligation of the Client to pay the price indicated on the corresponding invoice sent. The price is paid by bank transfer to the bank account or PayPal account of the Provider (whose details are communicated to the Client on the invoice).
Some banks may apply international transfer fees. This is not the responsibility of MyDog&Travel but only of the bank chosen to make the bank transfer.
The price is payable in full and in one single payment within 5 working days after the invoice has been sent by e-mail.
The payment made by the Client will only be considered definitive after the Provider has received the full amount due. MyDog&Travel charges for its search time. No payment can be refunded. The invoice must be paid before MyDog&Travel carries out the research and organizes the Client's trip. The Provider will wait for the receipt of the bank transfer on his bank account before starting the search.
The Client will receive confirmation by email of the payment of the order. MyDog&Travel reserves the right to refuse access to the Services, or to suspend it, in the event of a payment incident or in the event of fraud, attempted fraud or risk of fraud in connection with the use of the site.
The Provider will not be obliged to provide the Services ordered by the Client if the Client does not pay the full price in accordance with the conditions indicated above.
Article 5 - Right of withdrawal or cancellation
Given the nature of the Services provided by MyDog&Travel, the orders placed by the Client do not benefit from the right of withdrawal. The contract is definitively concluded as soon as the Client places the order in accordance with the terms and conditions set out in these GT&CS.
No reimbursement will be made for the service provided, since the billing corresponds to the time spent researching and designing the trip and not to the actual trip.
The Client is free to proceed or not to the reservations with the proposed Third Party Providers.
Article 6 - Provision of services
The Provider sends the Client by e-mail a digital file containing the details of the trip as well as all the booking links of the proposed services. The final responsibility for making reservations for accommodation, transport and activities among the suggestions of the Provider lies with the Client. MyDog&Travel will not make any reservations on behalf of the Client and will not act as an intermediary before, during or after the trip with the final Third Party Provider(s).
MyDog&Travel advises the Client to check the accuracy of the information contained in the links provided before proceeding with the payment of the reservation to the service provider (dates, number of persons, number of dogs, age of children, options to be included...).
MyDog&Travel will not be held responsible for the reservation of the Client with an organization or a Third Party Provider mentioned or not mentioned in the proposals of transport, accommodation or activities. When the Client makes a reservation with the Third Party Providers selected for his trip, the Client accepts that his reservations are subject to the General Terms and Conditions of Business of the Third Party Providers, and not to these General Terms and Conditions of Business.
The Client will initially receive, depending on the package selected, the following service proposals by email: the itinerary, round trip transportation, accommodation, a selection of dogfriendly activities and/or recommended addresses. The Client will have at his disposal the corresponding booking links in order to book the services directly with the Third Party Provider.
Then, when the Client has booked the selected services with the Third Party Providers, he will receive the details of the trip as well as all the bookings he has made in a tailor-made Travel Log. This Travel Log will be delivered to the Client in a PDF format by email. The precise content of this Travel Log is defined by the package chosen by the Client. Any modification of this booklet at the request of the Client and judged excessive by MyDog&Travel can involve an additional invoicing. In this case, a preliminary estimate subjected to validation will be established.
All documents will be sent to the address indicated by the Client. In order to carry out the order correctly, the Client therefore undertakes to provide truthful identification details.
The said Services will be provided within a reasonable period of time, previously communicated to the Client, according to the complexity and duration of the stay to be organized under the conditions provided for in the present GT&CS at the address indicated by the Client when placing the order on the website https://www.mydogandtravel.com.
Without news from the Client to move forward on the travel project after 7 working days of attempts to follow up by email and telephone, MyDog&Travel will not proceed with the design of the trip. At the end of this period, the proposals will be considered as accepted. MyDog&Travel will close the search and no further search can be made.
In case of a special request by the Client concerning the conditions of the provision of the services, duly accepted in writing by MyDog&Travel, the costs related to this will be the subject of a specific additional invoice at a later date.
Article 7 - Liability of the Provider and the Client
7.1 Liability of the Provider
Considering the nature of the Services provided, the obligation incumbent on the MyDog&Travel service provider is an obligation of means, to the exclusion of any obligation of result, which the Client expressly acknowledges.
As a reminder:

MyDog&Travel reserves the right to refuse any project that does not respect animal welfare.

MyDog&Travel is not a travel agency.
Each request is processed with the data sent by the Client (see reference to mandatory information in Article 3 - Ordering Procedures) from the beginning of the trip design. A change of destination, dates, or any other element leading to a complete new search cannot be processed, or will have to be the subject of a new quote.
MyDog&Travel undertakes to provide the Services diligently and in accordance with the state of the art as well as in compliance with the applicable legal and regulatory provisions, it being recalled that it has an obligation of means, to the exclusion of any obligation of result, which the Client expressly acknowledges. Some Third Party Services requested by the Client, such as a non-stop flight or a flight with specific stopovers, a strict travel duration (e.g. 9 days) without any flexibility of dates, or a specific type of accommodation (e.g. with heated swimming pool only), might not be feasible. Indeed, if no Third Party Service Provider responds to this type of request, MyDog&Travel cannot be held responsible by the Client. The latter will be informed in real time when searching for Third Party Services.
MyDog&Travel undertakes to do its utmost to respond favorably, but as far as possible, to the Client's requests.
The Client undertakes to make the reservations within 24 hours of receipt of the reservation links by MyDog&Travel, in order to benefit from the conditions found by MyDog&Travel. The Provider can in no way be held responsible for the failure of the reservation or for a variation in the price of the services offered (transport, accommodation, activities, etc...) if the Client does not make a reservation within 24 hours following the sending of the proposal e-mail, which the Client acknowledges and expressly accepts. No additional research will be carried out in case of price change or availability noticed after these 24 hours.
MyDog&Travel cannot be held responsible for any difficulties that may arise during the conclusion or execution of the contracts between the Client and any Third Party (accommodation, transport companies, activities, etc...) or between any other person involved in the proposed trip, nor can it be party to any dispute between the Client and these persons.
MyDog&Travel can in no way be held responsible in the event of difficulty or failure to make a reservation with the Third Party Providers offered. The prices of each Third Party Service (accommodation, transport, activities...) transmitted by MyDog&Travel to the Client are the prices quoted online or directly by the Third Party Service Provider on the date of sending the proposal e-mail. All Third Party Providers are free to change their prices without notice according to their own general terms and conditions. MyDog&Travel cannot be held responsible for any fluctuations in the prices charged by the Third Party Providers, which the Client expressly acknowledges.
MyDog&Travel provides a service of advice on travel arrangements and search for services in order to save the Client time. The responsibility for all the reservations and the smooth running of the holiday therefore lies solely with the Client. Thus MyDog&Travel cannot be held responsible for the bad progress of the stay, a bad experience of travel or Third Party Service, a cancellation or a modification on behalf of a Third Party Service Provider or an unforeseen event whatever its nature (loss of transport title, natural disasters, exceptional climatic conditions, internal or national strikes, wars, riots, economic, political or sanitary crisis, physical and material accident, theft...).
The rates, schedules, travel times and any other information on the Third Party companies mentioned in the customized Travel Log sent to the Client are given as an indication, subject to omissions, printing errors or currency fluctuations. The information transmitted by MyDog&Travel is valid on the date of edition of the Travel Log. MyDog&Travel cannot be held responsible for any subsequent modification of the edition of the Travel Log.
MyDog&Travel makes every effort to provide information on the https://www.mydogandtravel.com website that is as accurate as possible. However, it could not be held responsible for the omissions, the inaccuracies and the deficiencies in the update, that they are of its fact or the fact of the Third partners who provide him this information. All the information indicated on the site https://www.mydogandtravel.com is given as an indication, and is likely to evolve. In addition, the information on the website https://www.mydogandtravel.com is not exhaustive. It is given subject to modifications having been made since it was put on line.
7.2 Specific Responsibilities of the Client and Particular Situations

In case of loss, damage or theft during the trip, MyDog&Travel cannot be held responsible.

The validation of the order is subordinated to the capacity of the Client to orientate himself in order to have complete control over his journey.

The Client is the sole judge of his personal and physical ability to participate in the trip. The Client is aware that the countries visited may have different standards from the European Union, particularly in terms of laws, security, medical services, accommodation facilities and the quality of the road network, etc...

As the owner of an animal, you are the only one responsible for it. MyDog&Travel can in no way be held responsible for any lack of general respect, any damage or endangerment of others caused by your dog - and therefore by yourself. MyDog&Travel advises you to use Third Party Providers who have approved or expressly stipulated in writing the acceptance of dogs. MyDog&Travel cannot be held responsible if a Third Party Provider refuses you access due to lack of papers or other formalities. You must always keep your pet's health record/passport with you.

In fact, we are in no way responsible for your pet and/or the treatment of your pet by/at the recommended Third Party Providers. All Third Party Providers have been approved to take in one or more dogs. If you notice an unpleasant and non-dogfriendly attitude, or an attitude that does not comply with the commitments of the Third Party Provider, please inform MyDog&Travel so that the Third Party Provider can be identified as non-dogfriendly.

MyDog&Travel cannot be held responsible in any way if the reception facilities and consumables made available do not meet the advertised standards and cause material or physical damage.
7.3 Travel Documents, Formalities and Travel Insurance
The information provided by MyDog&Travel on administrative formalities is purely indicative, as it may be modified by the competent authorities after our documents have been printed. The Client is therefore required to contact the competent authorities before his departure. The accomplishment of the procedures and the expenses related to the customs or sanitary formalities (vaccinations, sanitary measures following a pandemic...) are the sole responsibility of the Client.
Worldwide health data, for example, are available on the Institut Pasteur website: https://www.pasteur.fr/
It should be noted that for destinations requiring a visa, the price and the necessary formalities to obtain it will be indicated for information purposes only and may be subject to change at any time. It is the Client's responsibility to check for any updates before departure.
MyDog&Travel does not cover travelers in case of illness or hospitalization during the trip. The Client is therefore strongly advised to take out a repatriation assistance insurance policy before the trip, as well as a cancellation insurance policy for third-party services. This is the sole responsibility of the Client.
MyDog&Travel makes every effort to provide its clients with as much information as possible about the administrative and health formalities to be completed in the various countries of travel. In order to be aware of the economic, political and sanitary situation of the chosen destination, before and during the stay, MyDog&Travel recommends to regularly consult the website of the Ministry of Foreign Affairs, in order to be aware of the advice given to travellers and to inform oneself about the potential risks related to the destination, at the time of departure.
To be allowed to travel in Europe, your dog must at least :

Be identified: by a microchip, to be checked before leaving to avoid any inconvenience, or a tattoo if done before July 3, 2011 (with certificate)

Have a passport in his name: ask your veterinarian (veterinarian's signature is required)

Be vaccinated against rabies: make sure your pet is vaccinated against rabies (check the validity period of the vaccine), and have a veterinary certificate issued or approved by the competent authority in the country of origin

Be dewormed: some countries also require that a deworming treatment be administered between 24 hours and 120 hours before entering the country (information specified in the Travel Log)
Beware! This list is not exhaustive and may change over time and depending on the destination. Moreover, for any trip outside the European Union, other formalities may be added. It is the Client's responsibility to find out about all these formalities before departure.
Any failure to comply with these legal obligations is strictly the responsibility of the Client.

For any request to organize a trip, the Client must imperatively indicate to MyDog&Travel the breed of his dog. For all categorized dogs 1 and 2, the Client must comply with the legal provisions in force in France and in the country(ies) visited: registration in the LOF, certificate of aptitude, specific civil liability insurance, etc... Traveling with dogs categorized 1 or 2 outside French borders involves a very important difficulty, even an impossibility to enter certain countries. The Client must be fully aware of this at the time of his request. MyDog&Travel cannot be held responsible for this.
Article 8 - Personal data protection Policy
The Client is informed that the collection of his personal data is necessary for the sale of the Services, their realization and delivery, entrusted to the Provider. This personal data is collected only for the execution of the service contract.
The personal data collected on the website https://www.mydogandtravel.com are the following: name, surname, age of the participants in the trip, breed of dog, telephone number, e-mail address, postal address of the Client.
The personal data is reserved for the sole use of the Provider. The data controller is the Provider, within the meaning of the French Data Protection Act and as of May 25, 2018 of Regulation 2016/679 on the protection of personal data.
Unless the Client expresses his express consent, his personal data will not be used for advertising or marketing purposes.
The Provider will keep the data thus collected for a period of 5 years, covering the period of limitation of the applicable contractual civil liability.
In accordance with the law n°78.17 of January 6, 1978, relating to data processing, files and freedoms, the Client has the right to access and rectify personal information concerning him that MyDog&Travel holds for the needs of its activity.
The Provider implements organizational, technical, software and physical measures in the field of digital security to protect personal data against alteration, destruction and unauthorized access. However, it should be noted that the Internet is not a completely secure environment and the Provider cannot guarantee the security of the transmission or storage of information on the Internet.
In accordance with the regulations applicable to personal data, Clients using the https://www.mydogandtravel.com website have the following rights:

They can update or delete their data by contacting the Provider by email at contact@mydogandtravel.com or by filling in the contact form available on the site.

They may request the deletion of their personal data, in accordance with applicable data protection laws, by writing to the address contact@mydogandtravel.com

Finally, they may object to the processing of their data by the Provider.
These rights, as long as they are not opposed to the purpose of the processing, can be exercised by sending a request by e-mail to the data controller. The latter must provide a response within a maximum of one month.
The Client may be asked to tick a box under which he agrees to receive informative and advertising emails from the Provider. He will always have the possibility to withdraw his agreement at any time by contacting the Provider (contact details above).
Article 9 - Right of publicity
Every Client declares that he authorizes MyDog&Travel to use his image (photo and/or video) on all media, in order to promote our activity worldwide. This authorization is granted without condition of duration and without financial compensation.
To refuse this authorization, the Client must make an express request to contact@mydogandtravel.com
Article 10 - Intellectual Property Rights
The content of the website https://www.mydogandtravel.com is the property of the Provider and is protected by French and international laws on intellectual property. Any partial or total reproduction of this content is strictly forbidden and is likely to constitute an infringement of copyright.
Any partial or integral reproduction of the Travel Log without the written consent of MyDog&Travel would be illicit and would constitute a counterfeit sanctioned by the provisions of the French Penal Code. The majority of the photos, videos, and the logo displayed on the website or the social networks of MyDog&Travel are its exclusive property and cannot be used without its consent. The possible other media are the object of an express authorization on behalf of the owner and carry a Copyright.
Article 11 - Applicable law - Language
The present GT&CS and the operations which result from them are governed and subjected to the French law. The present GT&CS are written in French. In the event that they are translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute.
Article 12 - Disputes
Any complaint relating to a research service must be sent within a maximum of 14 days after receipt of the Travel Log. In case of dispute, only the Court of Bordeaux (33, France) will be competent.
